Common Declaration
It is hereby announced that an important agreement
has been concluded between Outline di Noselli G. & C. s.n.c., owner
of the Italian design model BS200O000020, the international design
model DM / 062394 and the US-American design model D500,306 S, and
Stamer Musikanlagen GmbH and Music & Sales Professional Equipment
GmbH. Persuant to this agreement, Stamer Musikanlagen GmbH and Music
& Sales Professional Equipment GmbH entirely acknowledge the design
models of Outline di Noselli G. & C. s.n.c. and oblige themselves to
respect such, while Outline di Noselli G. & C. s.n.c. tolerates the
manufacturing, offering and distribution of the product COHEDRA by
Stamer Musikanlagen GmbH and Music & Sales Professional Equipment
GmbH. Outline di Noselli G. & C. s.n.c. solicits the other market
participants to refrain from commercializing line-array loudspeakers
which infringe the above mentioned intellectual property rights.
Outline di Noselli G. & C. s.n.c. declarates to institute legal
actions in any case of infringement of its intellectual property
rights.

Outline Butterfly: the U.S. also
grants a patent
At the end of December 2004, the United States
granted Outline patent
“US
D500,306 S”
regarding the design of its Butterfly line array (hi-pack C.D.H. 483
element). The patent’s priority is dated 9th July 2002.
This acknowledgment, granted after a lengthy period
of examination by the U.S. Patents Office, gives Butterfly a great
added value and, after the International WIPO patent, is further
confirmation of the originality of the Butterfly’s design,
relegating the numerous variations that have appeared at
international level to the role of mere imitations.
The following is a list of patents and numerous
applications for patents (some still at the approval stage)
regarding the overall Butterfly system:

Following false misleading information
deliberately spread in trade circles by individuals who have so far
remained unidentified, Outline wishes to state that its
"Butterfly" series line array is an original proprietary
product, protected by Italian and international patents and patent
applications (see above), and therefore intends taking legal action against any
persons causing it any damage whatsoever with his or her behaviour.
Having also found line array systems almost identical to its
"Butterfly" model on the market, Outline also advises all
trade members to be extremely cautious when purchasing such
equipment which may be counterfeit versions or imitations of the
products covered by the patents, models and/or patent applications
shown hereunder and therefore constitute patent infringement.
In
fact, in compliance with current laws in the various countries,
Outline reserves the right to take legal action to safeguard its
patent rights against anyone manufacturing, selling or in any way
using for commercial purposes line arrays which are imitations or
falsifications of the unique original "Butterfly" form.
